How to Make a Warranty Claim:

Metro LED Lighting assists our clients by obtaining a Return Material Authorization (RMA) from the applicable Manufacturer, for fixtures that are being requested to have a warranty review.

To request an RMA, the customer shall provide:

  1. Date of Purchase, and the Original PO or order information for the item.
  2. The specific line item on the Original PO that is being requested for service under the Manufacturer’s Warranty.
  3. Provide the number of items that are being request for warranty review, and the part numbers if available.

For items that have been discontinued or are no longer available, Metro LED Lighting will seek to find a repair facility to service the item. It is at the sole discretion of buyer whether to use this service, and the buyer is responsible for all costs associated with these repairs. Metro LED Lighting provides this as a courtesy service to our customers and is not responsible for any agreements between the repair house, and the customer. There are no warranties offered or implied by providing this service.

After contacting Metro LED Lighting for a request for as Manufacturer’s Warranty Services, we will:

  1. Contact the Manufacturer to request a RMA be issued.
  2. Forward to you the Manufacturer’s instructions and authorization for the fixture or item being requested to be serviced under the Manufacturer’s Warranty Terms.

The Manufacturer’s Warranty Policies govern requirements for items, such as, but not limited to, period of the warranty, warranty notification, shipment costs, repair or replacement of the fixture, returned condition of the fixture, and determination of the defect. Manufacturer’s Warranties are available upon request, and govern all terms and conditions of warranty. Metro LED Lighting facilitates the repair service requests, and makes no representations about Warranty Services or the Manufacturer’s policies. Nothing outlined above modifies the original terms and conditions of sale. Please contact us to request a Manufacturer’s Warranty Service if needed.

Terms and Conditions of Sale

The following Terms and Conditions of Sale apply to all orders from Metro LED Lighting, and can only be modified by the provisions detailed in item 11 listed below.

  1. Order Acceptance: Acceptance of any order from buyer ("Buyer") is subject to approval and acceptance by Metro LED Lighting ("Metro") and, when applicable, Metro’s suppliers. Metro reserves the right to accept or reject any order.

  2. Prices and Shipments: Prices shall be those in effect at the time Metro accepts the applicable order from Buyer. Prices listed do not include shipping, handling fees, taxes, and/or duties, and are subject to correction or change without notice. All shipments will be made F.O.B. shipping point.

  3. Shipping Policies: (a) The price of shipping is determined by the shipping method you choose, your order's total weight, as well as the distance between your shipping address and the manufacturers shipping point. The shipping charge will be actual charges from the supplier/ manufacturer and will be included on Metro’s invoice. (b). Buyer may elect to pay a premium for expedited shipping where available from the supplier/ manufacturer. Any charges incurred for special handling by the carrier must be paid by the Buyer. (c) Metro only accepts orders for shipments within the continental US. Orders to international destinations or to Alaska, Hawaii or Puerto Rico or other US territories will not be processed without prior special arrangements. Metro does not ship to PO Box addresses or APO/FPO boxes. (d) Title and risk of loss pass to Buyer upon tender of shipment to the carrier. (e) In addition, claims for shortages, other than loss in transit, must be made by Buyer in writing not more than five (5) days after receipt of shipment.

  4. Return of Goods: The Buyer is responsible for the method and cost of return to Metro.

    Return of Stock Merchandise: No merchandise may be returned without prior written authorization from Metro. Requests to return merchandise must be made within 30 days from date of shipment by supplier or manufacturer. All returns must be shipped prepaid by Buyer to the location designated on the return authorization. Credit will be issued based on the original invoice price, or price in effect at time of return, whichever is lower, less a minimum disposition charge of 35% (to defray the cost of handling). All returned product must be in new, salable condition in order to qualify for credit. Return authorization will not be granted when the value of all items to be returned is less than $300.

    Non-Returnable Merchandise: The following products are not returnable: all non-stock, special, custom made or modified products; all stock products containing time-sensitive components that have reached the end of their warranty or shelf life; outdated or phase-out stock products; and all items manufactured specifically for the Buyer.

    Cancellations: Stock products may be cancelled prior to shipment without charge. Cancellation of any order for non-stock products will incur charges for work already performed and for material purchased by supplier or manufacturer. Cancellation of any product order after shipment will be subject to the return provisions of these Terms and Conditions of Sale.

    Receipt of Damaged Material: If Buyer receives a damaged/defective item or item not as ordered, please contact Metro's customer service department immediately at 1-(518)-409-8090.

    Warranty Returns: Contact Metro Support at 1-(518)-409-8090 (info@MetroLEDLighting.com) to determine manufacturer's warranty eligibility.

  5. Taxes: Prices shown do not include sales or other taxes imposed on the sale of goods. Taxes now or hereafter imposed upon sales or shipments will be added to the purchase price. Buyer agrees to reimburse Metro for any such tax as assessed by the responsible tax jurisdiction.

  6. Delay in Delivery: Metro is not to be accountable or liable for delays in delivery or other failures in performance occasioned by acts of God, failure of its suppliers to ship or deliver on time, or other circumstances beyond Metro's reasonable control. Factory shipment or delivery dates are the best estimates of Metro and its suppliers and are not guaranteed. In no case shall Metro be liable for any special, incidental, direct, indirect, consequential, punitive, exemplary or special damages (whether sounding in contract, tort, strict liability, or otherwise), all regardless of whether Metro knew or should have known of the possibility of such losses, arising from any delay in shipment or delivery.

  7. Disclaimer of Warranties: ANY DESCRIPTION OF THE GOODS CONTAINED ON ANY METRO WEB SITE DESCRIPTION, QUOTATION, PURCHASE ORDER, ORDER ACKNOWLEDGEMENT, BILL OF LADING OR SALES INVOICE IS FOR THE SOLE PURPOSE OF IDENTIFYING THEM, AND DOES NOT CONSTITUTE A WARRANTY THAT THE GOODS SHALL CONFORM TO THAT DESCRIPTION. METRO MAKES NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR OTHERWISE (INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT) WITH RESPECT TO ANY GOODS SOLD BY METRO TO THE BUYER, AND METRO HEREBY DISCLAIMS ALL SUCH WARRANTIES. For purposes of clarification, Metro only sells the goods to Buyer with a warranty directly from the manufacturer or supplier. Buyer's remedies under this agreement are subject to any limitations contained in manufacturer's terms and conditions to Metro, a copy of which will be furnished upon written request.   8. Waiver: The failure of Metro to insist upon the performance of any of the terms or conditions of this agreement or to exercise any right hereunder shall not be deemed to be a waiver of such terms, conditions, or rights in the future, nor shall it be deemed to be a waiver of any other term, condition, or right under this agreement.

  9. Modification of Terms and Conditions: These terms and conditions supersede all other communications, negotiations, and prior oral or written statements regarding the subject matter of these terms and conditions. No change, modification, rescission, discharge, abandonment, or waiver of these terms and conditions shall be binding upon Metro unless made in writing and signed on its behalf by a duly authorized representative of Metro. No conditions, usage of trade, course of dealing or performance, understanding or agreement, purporting to modify, vary, explain, or supplement these terms and conditions shall be binding unless hereafter made in writing and signed by the party to be bound. Any proposed modifications or additional terms are specifically rejected and deemed a material alteration hereof.

  10. Assignment: Buyer shall not assign its rights or delegate its duties hereunder or any interest herein without the prior written consent of Metro, and any such assignment, without such consent, shall be void.

  11. General Provisions: This agreement shall be governed by the laws of the State of New York. All suits arising from or concerning this agreement shall be filed in the Circuit Court of Albany, New York and no other place unless otherwise determined in Metro's sole discretion. Buyer hereby irrevocably consents to the jurisdiction of such court or courts and agrees to appear in any such action upon written notice thereof.

  12. Payment Terms: Buyer agrees to pay the prices quoted by Metro, and is responsible for applicable shipping and handling charges, taxes and duties. If Buyer does not pay any invoice, in whole or in part, when due, Metro shall assess a finance charge on any past due balance at the maximum legal rate permitted on open accounts. If any amount due Metro is collected by or through an attorney, Metro shall be entitled to recover all costs of collection, including attorney’s fees equal to 15% of the total principal and interest owed.

  13. Exporting: All items are sold for domestic consumption in the United States. Buyer acknowledges that this order and the performance thereof are subject to compliance with any and all applicable United States laws, regulations, or orders. Buyer agrees to comply with all such laws, regulations, and orders.

  14. Product Compliance and Suitability: Jurisdictions have varying laws, codes and regulations governing construction, installation, and/or use of products for a particular purpose. Certain products may not be available for sale in all areas. Metro does not guarantee compliance or suitability of the products it sells with any laws, codes or regulations, nor does Metro accept responsibility for construction, installation and/or use of a product. It is Buyer's responsibility to review the product application and all applicable laws, codes and regulations for each relevant jurisdiction to be sure that the construction, installation, and/or use involving the products are compliant.

  15. Errors; Cancellations: All stenographic or clerical errors are subject to correction by Metro. Metro attempts to ensure that the content on its web sites is complete and current. However, Metro cannot guarantee that the information contained on its web sites will not contain errors, inaccuracies, or omissions. Such errors, inaccuracies, or omissions may relate to price, product description, availability, or otherwise. Metro reserves the right to correct any error, inaccuracy, or omission, or to change or update the content without prior notice to Buyer. Further, Metro reserves the right to refuse or cancel any orders (including without limitation any orders containing any error, inaccuracy, or omission) at any time and for any reason whatsoever whether or not the order has been submitted, confirmed, and/or Buyer' s credit card has been charged. If Buyer's credit card has been charged for the purchase and Buyer's order is canceled by Metro, Metro shall promptly issue a credit to Buyer's credit card. Except for issuing such credit (if applicable), Metro shall have no liability or obligation to Buyer with respect to any cancelled order.

  16. Miscellaneous:

    Substitutions: Products (and country of origin) may be substituted and may not be identical to catalog or website published descriptions and/or images.

    Limitation Of Liability: The total liability of Metro on any and all claims of any kind, whether in contract, warranty, tort (including negligence), strict liability or otherwise, arising out of or in connection with, or resulting from, Metro’s sale, delivery, resale, repair, or replacement of any products, service offerings, or the performance of any services, shall in no event exceed the purchase price allocable to the specific product or service which gives rise to the claim, and any and all such liability shall terminate upon the expiration of the applicable warranty period. Metro shall not be liable for damages that result from the delivery of products or the performance of services that do not occur within purchaser’s specified time frame or for any delay or default in delivering products or performing services where occasioned by any cause beyond the control of Metro, including without limitation embargoes; shortages of labor, raw materials, or fuel; fires; floods; accidents; acts of war; or other similar causes. IN NO EVENT SHALL METRO BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF THE SALE OR PERFORMANCE OF ANY PRODUCTS, SERVICES OR SERVICE OFFERINGS, OR ANY BREACH OF WARRANTY OR OBLIGATIONS UNDER WARRANTY, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER AS THE RESULT OF BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, INCLUDING WITHOUT LIMITATION LABOR OR EQUIPMENT REQUIRED TO REMOVE AND/OR REINSTALL ORIGINAL OR REPLACEMENT PARTS, LOSS OF TIME, PROFITS OR REVENUES, LACK OR LOSS OF PRODUCTIVITY, INTEREST CHARGES OR COST OF CAPITAL, COST OF SUBSTITUTE EQUIPMENT, SYSTEMS OR SERVICES, DOWNTIME COSTS, LOSS OR CORRUPTION OF DATA, LOSS OF USE OF PROPERTY OR EQUIPMENT, OR ANY INCONVENIENCE.
